MEMORANDUM, OPINION AND ORDER


For the foregoing reasons, this Court adopts Magistrate Judge Brown's 5/5/2004 Report and Recommendation. Motions [34-1], [36-1] are granted. Motion [36-2] is denied as moot. Motions [56-1], [59-1, 2], [56-2, 3] are denied. Defendants are directed to submit to Judge Brown a petition for reasonable fees and costs by 10/29/2004. This case is hereby terminated. This is a final and appealable order. It is so ordered.
