WELLS, J., grants since the majority denied the joint stipulation to dismiss. The case should be dismissed because the United States Court of Appeals for the Eleventh Circuit withdrew the certified question and this Court does not therefore have jurisdiction.

Appellant's Motion for Attorney Fees is hereby denied.
