MOTION DECISION
Present - Hon. Sallie Manzanet-Daniels, Justice Presiding, Jeffrey K. Oing Tanya R. Kennedy Martin Shulman Julio Rodriguez III, Justices.
Appeals having been taken to this Court from orders of the Supreme Court, New York County, entered on or about April 12, 2022 (Case No. 2022-01552); March 08, 2022 (Case No. 2022-01554); March 29, 2022 (Case No. 2022-02227); May 13, 2022 (Case No. 2022-02304); and from a judgment of the same court and justice, entered on or about April 15, 2022 (Case No. 2022-02226), and said appeals having been perfected upon a single record and brief, And Tara Diamond, Esq., appointed counsel for the subject children having moved: (1) to be relieved as such counsel; (2) to appoint an attorney for the children on appeal upon a finding pursuant to 22 NYCRR Part 36; (3) to extend the time for newly appointed counsel to submit a brief in response to the perfected appeals; and (4) to extend the time for newly appointed counsel for the children to respond to defendant-appellant's separate motion for a stay pending appeal (Motion No. 2023-00504), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of relieving Tara Diamond, Esq., as appointed counsel for the subject children with respect to responding to the appeals; however, Tara Diamond, Esq., is permitted to respond on behalf of the subject children to the aforesaid motion for a stay pending appeal (Motion No. 2023-00504), and her time to do so is extended to March 13, 2023. The motion is otherwise denied.
