ORDER MODIFYING OPINION AND DENYING REHEARING (Allan J. Goodman, Judge) CHANGE IN JUDGMENT

THE COURT:

IT IS ORDERED that the opinion filed herein on July 30, 2007, be modified in the following particulars:

On page 10, under DISPOSITION, delete the last sentence of the typed opinion, that reads “The parties shall bear their own costs on appeal.” and in its place, the following, so that the sentence now reads:

The costs on appeal, including the premium and any other necessary costs in procuring the appellate bond, shall be borne by the parties in proportion to their interest in the property.

This modification does constitute a change in the judgment.

The appellant’s petition for rehearing is denied.
