ORDER

Kathleen Kerrigan, Chief Judge

On August 3, 2023, respondent filed a Motion To Dismiss for Lack of Jurisdiction and on August 17, 2023, filed a first supplement thereto. On September 6, 2023, the Court ordered petitioner to file a response to respondent's motion, as supplemented, on or before October 2, 2023.

On October 2, 2023, petitioner submitted a document that was filed at Docket Entry No. 12 as a "Response to Motion to Dismiss for Lack of Jurisdiction." Therein petitioner requested additional time to respond to the motion while he sought legal counsel.

Upon due consideration of the above, and for cause, it is

ORDERED that petitioner's document filed at Docket Entry No. 12 is hereby recharacterized as petitioner's Motion for Extension of Time. It is further

ORDERED that petitioner's Motion for Extension of Time is granted in that the time in which petitioner shall file an objection, if any, to respondent's Motion to Dismiss for Lack of Jurisdiction is extended to November 6, 2023. Failure to file an objection by this date may result in the granting of respondent's motion as supplemented and dismissal of the instant case or other appropriate action by this Court.
