Estate of Michael Knudsen v. Geoffrey Fieger

LC Nos. 2016-031437-NM; 2016-031442-NM

Michael J. Kelly Presiding Judge, Amy Ronayne Krause, Brock A. Swartzle Judges

ORDER

The Court orders that the motion for immediate consideration is GRANTED.

The motion to enforce this Court's October 27, 2022 stay order is also GRANTED. In accordance with this Court's October 27, 2022 order granting the motion for stay of proceedings, and pursuant to our authority under MCR 7.216(A)(7), we VACATE all trial court orders in this case entered after October 27, 2022. Further, the trial court shall not conduct any further proceedings in this case and shall not enter any further orders in this case until these appeals are decided.

Swartzle, J., I would deny the motion to enforce primarily because I do not believe a stay by this Court was appropriate in the first instance, and, moreover, the entry of the subject orders reduced to writing what the circuit court had already ordered prior to this Court's stay.
