In the Matter of the Application of Shameeka Crocker Knox and Demetrius Knox, Petitioners, For a Judgment Pursuant to Article 78 of the Civil Practice Law and Rules v New York City Housing Authority, Respondent.
An Article 78 proceeding having been transferred to this Court, pursuant to CPLR 7804(g), by order of the Supreme Court, New York County, entered on or about March 20, 2019, to review a determination of the New York City Housing Authority, And petitioner, Shameeka Crocker Knox, having moved for an order staying eviction proceedings by respondent and its attorneys in the Civil Court of the City of New York, New York County, Housing Part, under Index # 17769/18, pending hearing and determination of the transferred petition, and other relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of staying the trial in the housing court proceeding on the condition that petitioners perfect the transferred proceeding on or before December 2, 2019, for the February 2020 Term. The transferred proceeding shall be heard on the original record and upon a reproduced petitioners' brief, on condition that petitioners serve one copy of such brief upon the attorney for respondent and file an original, five hard copies and, if represented by counsel, one digital copy of such brief, together with the original record, with this Court pursuant to Section 1250.9 of the Practice Rules of the Appellate Division. Petitioners are permitted to dispense with payment of the required fee for the subpoena and filing of the record.
