Gen. No. 44,587. (Abstract of Decision.)
Opinion filed March 16, 1949 Rehearing denied April 19, 1949 Released for publication April 20, 1949
AUTOMOBILES AND MOTOR VEHICLES, § 121.3 — evidence of personal mission of police officer. In action for injuries sustained in intersectional collision between plaintiffs' automobile and a police squad car driven by defendant, a village police officer, evidence for plaintiffs was sufficient to warrant verdict and judgment in their favor on ground that at time of collision defendant was on a personal mission, as against contention that defendant was then in fresh pursuit of a suspected speeder and was therefore performing a governmental function as a police officer.
