Ronald S Klimkewicz v. Sarah L Klimkewicz

LC No 18-037321-DM

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction. First, the September 15, 2022 order appealed from is not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). Particularly, this order denying a motion to revoke paternity is not an order granting or denying a motion to change legal custody, physical custody, or domicile so as to be a final order under MCR 7.202(6)(a)(iii). Further, the claim of appeal was not timely filed under MCR 7.204(A)(1)(d) because the relevant trial court motion for reconsideration was not filed within 21 days after entry of the September 15, 2022 order and the trial court did not extend the time for filing the motion for reconsideration. Dismissal is without prejudice to the filing of a delayed application for leave to appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
