JUDGMENT


In accordance with the Opinion and Order Granting Plaintiffs' Motion for Summary Judgment and Denying Government's Motion for Summary Judgment entered on August 2, 2004, and the Order Directing the Entry of Judgment Pursuant to Rule 54(b) of the Federal Rules of Civil Procedure entered this date,

It is ORDERED AND ADJUDGED that the plaintiffs Phyllis F. Klender, William B. Rase, and Roger J. Petri shall recover of the defendant, the United States of America, the following sums: plaintiff Phyllis F. Klender shall recover the amount of $120.90 representing an overpayment of Federal Insurance Contributions Act ("FICA") taxes withheld by her employer for tax year 2000; plaintiff William B. Rase shall recover the amount of $2,295.00 representing an overpayment of FICA taxes withheld by his employer for tax year 2001; plaintiff Roger J. Petri shall recover the amount of $2,142.00 representing an overpayment of FICA taxes withheld by his employer for tax year 1998 in the amount of $1,185.75 and FICA taxes withheld by his employer for tax year 1999 in the amount of $956.25; together with interest and costs of the action as permitted by law.
