In view of the Court's Order served January 3, 2024, it is

ORDERED that the Court's Order served January 3, 2024, is amended in that the second Ordered paragraph is deemed to read as follows:

ORDERED that, on or before March 4, 2024, respondent shall file either (1) an appropriate motion to dismiss for lack of prosecution as to petitioner Raymond Kleinsmith, Deceased, along with a stipulation of settlement, or (2) a status report concerning the then-current status of this case or another appropriate filing.

It is further

ORDERED that, in all other respects, the Court's Order served January 3, 2024, remains in full force and effect.
