Appellate Division of the Supreme Court of New York, Second Department
Mar 24, 1952
279 App. Div. 935 (N.Y. App. Div. 1952)

Opinion

March 24, 1952.

In an action for separation, defendant appeals from an order fixing temporary alimony and counsel fee. Order modified by striking from the first ordering paragraph "Forty ($40.00) Dollars" and substituting therefor "Thirty ($30.00) Dollars"; by striking from the second ordering paragraph "Three Hundred and Fifty ($350.00) Dollars" and substituting therefor "Two Hundred ($200.00) Dollars"; and by striking from the third ordering paragraph "One Hundred and Fifty ($150.00) Dollars" and "Two Hundred ($200.00) Dollars" and substituting therefor "One Hundred ($100.00) Dollars" in each instance. As so modified, the order is affirmed, without costs. The amounts fixed were excessive. Nolan, P.J., Carswell, Adel, Wenzel and Schmidt, JJ., concur.
