Order denying defendant's motion to dismiss complaint for insufficiency, or to strike out certain allegations in paragraphs 5 and 8 thereof as irrelevant, or to direct plaintiff to serve an amended complaint, affirmed, with ten dollars costs and disbursements, with leave to defendant to serve an answer within five days from service of a copy of the order herein upon payment of such costs. No opinion. Lazansky, P.J., Rich, Kapper, Hagarty and Scudder, JJ., concur.
