MEMORANDUM OPINION

ROBBIE PARTIDA-KIPNESS, JUSTICE

By motion filed May 31, 2022, appellants inform the Court they no longer wish to pursue the appeal and request the appeal be dismissed. See Tex. R. App. P. 42.1(a)(1). We grant the motion and dismiss the appeal. See id.

JUDGMENT

In accordance with this Court's opinion of this date, we DISMISS the appeal.

Subject to any agreement among the parties, we ORDER that appellee Preston Parker Crossing, Ltd. recover its costs, if any, of this appeal from appellants K&K Enterprises, LLC, d/b/a Innovative Interiors, Gary Kelley, Cheryl Kelley and Henry Kelley.

Judgment entered this 7th day of June, 2022.
