K.J.S. v. State

District Court of Appeal of Florida, First District
Sep 27, 2006
937 So. 2d 1174 (Fla. Dist. Ct. App. 2006)

Opinion

No. 1D06-1846.

September 5, 2006. Rehearing Denied September 27, 2006.

An appeal from the circuit court for Nassau County. Robert E. Williams, Judge.

Nancy A. Daniels, Public Defender, and David P. Gauldin, Assistant Public Defender, Tallahassee, for Appellant.

Charlie Crist, Attorney General, and Terry P. Roberts, Assistant Attorney General, Tallahassee, for Appellee.

We affirm the revocation of probation as amply supported by the record. The remaining issues raised by appellant, including those related to assessment of costs, fees and surcharges, were unpreserved by either a timely objection or a motion pursuant to Florida Rule of Juvenile Procedure 8.135(b)(2) and do not implicate fundamental error. Accordingly, we may not consider them. See generally A.M.P. v. State, 927 So.2d 97 (Fla. 5th DCA 2006).

AFFIRMED.

ERVIN, WEBSTER, and HAWKES, JJ., concur.
