Opinion

No. 43736.

June 8, 1973.

Appeal and error — review — finding of trial court.

Action in the St. Louis County District Court for specific performance of a contract whereby defendant allegedly agreed to sell certain real estate to plaintiff. After findings for plaintiff, Mitchell A. Dubow, Judge, defendant appealed from an order denying his motion for a new trial. Affirmed.

M. H. Greenberg and Ben P. Constantine, for appellant.

William R. Ojala, for respondent.

Heard before Knutson, C. J., and Rogosheske, Peterson, and Kelly, JJ.

The issue in this case is simply whether the evidence was sufficient to support the finding of the trial court that a legally binding purchase agreement existed between the parties. We hold that it was.

Affirmed.
