JOHN W. KITZMILLER, MD PC, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

David Gustafson, Judge.

In compliance with our standing pretrial order, the Commissioner has filed a status report. We appreciate the parties' work in resolving this case. The report consists of a single paragraph that states: "Parties are close to a settlement agreement in this case does see the need for a trial." There seem to be several words missing, possibly including the word "not". We would note, in addition, that a status report that reports an expected settlement (as this one seems to do) will optimally state that the parties expect to file a proposed stipulated decision and whether they expect to be able to do so before the beginning of the trial session. (If instead they expect to need more time to prepare, sign, and file the document, then they should presumably be filing a motion for a continuance.)

It is

ORDERED that, no later than August 23, 2022, the parties shall file a status report (unless before then they have filed a proposed stipulated decision).
