This case is calendared for trial at the November 14, 2016, Tampa, Florida Trial Session of the Court. On June 13, 2016, respondent filed a Motion to Show Cause Why Proposed Facts and Evidence Should Not Be Accepted as Established, pursuant to Tax Court Rule 91(f). On June 27, 2016, the Court granted respondent's motion and ordered petitioner to file a response to the order to show cause on or before July 27, 2016. Petitioner has not filed a response to the Court's July 27, 2016, Order to Show Cause.
After due consideration and for cause, it is
ORDERED that so much of the Court's July 27, 2016, Order to Show Cause that relates to respondent's proposed stipulations 1 through 5 and exhibits 1-J and 2-J are absolute, and these stipulations are accepted as established. The remainder of the Court's Order to Show Cause is hereby discharged.
