DAN O. KIS & ERIKA KIS, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Patrick J. Urda, Judge.

On June 12, 2024, petitioners Dan O. Kis and Erika Kis filed a motion to enforce a refund of overpayment pursuant to Rule 260. The Court subsequently issued an Order directing the Commissioner to file a response to the motion. On July 12, 2024, in lieu of a response, the Commissioner filed a status report informing the Court that a partial refund had been issued and requesting 45 days for the completion of payment. We will grant the Commissioner's request and determine at that time whether any additional relief is justified.

Upon due consideration, it is

ORDERED that, on or before September 3, 2024, the Commissioner shall file a response to the motion to enforce a refund of overpayment pursuant to Rule 260.
