This case is calendared for trial at the Oklahoma City, Oklahoma, trial session of the Court scheduled to begin on March 18, 2024. On February 22, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution. Respondent moves that the Court dismiss this case for lack of prosecution and find in its order that there is due from petitioner a deficiency in income tax for the taxable year 2014 in the amount of $609,890; that there is an addition to tax due from petitioner for the taxable year 2014, under the provisions of I.R.C. § 6651(a)(1), in the amount of $153,719; and that there is no penalty due from petitioner for the taxable year 2014 under the provisions of I.R.C. § 6662(a). Upon due consideration, it is
ORDERED that, on or before March 13, 2024, petitioner shall file a response to respondent's Motion to Dismiss for Lack of Prosecution. Petitioner is warned that if he fails to file a response, the Court may enter a decision against him as set forth in respondent's motion to dismiss.
