NO. 09-17-00231-CV

On Appeal from the 136th District Court Jefferson County, Texas
Trial Cause No. D-200 ,185
ORDER
The appellants, Kirbyville Consolidated Independent School District, Thomas A. Wallis, Georgia Sayers, Chad George, Joey Davis, Clint Smith, Amy Fountain, Marcia Morgan, D'Wanna Rasnick and Dustin Rutherford, filed a motion to stay all trial court proceedings and discovery during the pendency of their accelerated appeal from an order denying a plea to the jurisdiction. See Tex. Civ. Prac. & Rem. Code Ann. § 51.014(a)(8) (West Supp. 2016). The appellants complain that discovery motions have been scheduled for hearing notwithstanding the perfection of this accelerated appeal. Based on the express provision of section 51.014(b) of the Texas Civil Practice and Remedies Code, the appeal stays all proceedings in the trial court. Id. § 51.014(b).
When an accelerated appeal from an interlocutory order is perfected, we may make such orders as are necessary to preserve the parties' rights until disposition of the appeal. Tex. R. App. P. 29.3. After reviewing the appellants' motion, we grant the appellants' request for a temporary order staying the trial court proceedings pending the disposition of the appeal. It is ORDERED that all further trial court proceedings and discovery in Cause Number D-200,185 are STAYED until our Opinion issues or until further order of this Court. See id.; see also Tex. Civ. Prac. & Rem. Code Ann. § 51.014(b).
ORDER ENTERED June 22, 2017.
