Petitioner-appellant having moved, pursuant to CPL 330.20(21)(a)(i), for leave to appeal to this Court from an order of the Supreme Court, New York County, entered on or about December 09, 2020, and, should leave be granted, for a stay of enforcement of the order, pending hearing and determination of the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion, insofar as it seeks leave to appeal the entered on or about December 09, 2020, is granted, and

It is further ordered that motion, insofar as it seeks to stay enforcement of the order, including the transfer of respondent to a nonsecure facility, pending hearing and determination of the appeal and determination of the appeal, is granted. Entered: March 11, 2021
