ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

BY THE COURT:

The court orders the opinion filed herein on June 20, 2007 modified as follows:

On page 10, in the first full paragraph, after the third sentence, insert the following sentence: “As we have discussed, he also presented evidence from which a jury could infer Unocal knew or should have known his exposure to asbestos was hazardous.”

This modification does not alter the judgment. Appellant’s petition for rehearing is denied.
