ORDER


This matter having come before the Court upon pro se Plaintiff's appeal of the Magistrate Judge's decision and the motion of Defendants for summary judgment of Plaintiff's Amended Complaint; and the Court having considered the parties' submissions and decided the motions without oral argument, pursuant to Federal Rule of Civil Procedure 78; and for the reasons set forth in the Memorandum Opinion accompanying this Order; and for good cause shown;

IT IS this 29th day of June, 2006;

ORDERED that Plaintiff's appeal of the Magistrate Judge's March 31, 2006 Order [25] is DENIED and the Magistrate Judge's Order is AFFIRMED; and it is further

ORDERED that Defendants' motion for summary judgment [27] is GRANTED and Plaintiff's Amended Complaint is DISMISSED; and it is further

ORDERED that this case shall be marked closed.
