Having received responses from the State of Florida and the Fourth District Court of Appeal to this Court's order dated March 9, 2004, and having considered Petitioner's Motion to Voluntarily Dismiss, incorporated in his reply to the responses, as a proper notice of dismissal pursuant to Florida Rule of Appellate Procedure 9.350(b), it is ordered that the Petition for Writs of Mandamus and Prohibition be and the same is hereby voluntarily dismissed.

Petitioner's Emergency Motion for Stay of District Court Proceedings is hereby denied as moot in light of this disposition.
