MEMORANDUM OPINION


On August 13, 2002, we abated this cause due to Appellee's bankruptcy filing. Appellant has now filed a motion to dismiss his appeal. See TEX. R. APP. P. 42.1(a)(1). Appellee has not filed a response, and dismissal of this cause would not prevent a party from seeking relief to which it would otherwise be entitled.

Thus, as of the date of this opinion we lift the abatement and reinstate the appeal. Appellant's motion to dismiss is granted. The cause is dismissed.
