Lynne C King v. David Eugene King

LC No. 17-033768-DO

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because the December 13 2021 order appealed from is not a final order as defined in MCR 7.202(6). MCR 7.203(A)(1). Particularly the postjudgment order regarding spousal support is not an order that grants or denies a motion to change legal custody, physical custody, or domicile of a minor under MCR 7.202(6)(a)(iii). Dismissal is without prejudice to the filing of a delayed application for leave to appeal under MCR 7.205(A)(4) provided such a filing meets all requirements under the court rules and is not time-barred.

The Claim of cross appeal is also DISMISSED for lack of jurisdiction because there was no actual appeal of right to support the filing of the cross appeal. MCR 7.207(A)(1).
