CYNTHIA W. KING AND ALL OTHER OCCUPANTS, Appellant v. FORTY 200, Appellee

On Appeal from the County Court at Law No. 5 Dallas County, Texas
Trial Court Cause No. CC-15-06223-E

ORDER

Before Chief Justice Wright, Justice Lang and Justice Brown

Before the Court is appellant's Amended Expedited Emergency Motion to Pay Bond in Payments. Under the Texas Property Code, a judgment of a county court in a forcible detainer suit may not under any circumstances be stayed pending appeal unless, within 10 days of the signing of the judgment, the appellant files a supersedeas bond in an amount set by the county court. TEX. PROP. CODE ANN. § 24.007. Although the rules of appellate procedure provide a means for reviewing the amount of bond set by the trial court, see TEX. R. APP. P. 24.4, they do not provide a mechanism for allowing the bond set by the trial court to be paid in installments while that review is pending.

We DENY the motion.
