ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on December 10, 2002, the court determines that the findings and conclusions of the United States Magistrate Judge are correct. The findings and conclusions of the United States Magistrate Judge are hereby accepted by the court. The court denies Petitioner's Writ of Habeas Corpus as time-barred, and this action is dismissed with prejudice.

It is so ordered.
