Pending in the above-docketed matter is a Motion To Dismiss for Lack of Prosecution, filed September 13, 2021, by respondent herein. Thereafter, on September 30, 2021, the parties filed a Proposed Stipulated Decision resolving this litigation.

Accordingly, the premises considered, and commensurate with entry of the decision, it is

ORDERED that respondent's just-referenced Motion To Dismiss for Lack of Prosecution is denied as moot.
