Richard William Kincaid v. The State of Texas

Trial court: 82nd District Court of Falls County, Trial court case number: 11074.

ORDER

Veronica Rivas-Molloy, Judge.

During trial of this matter, the State's Exhibit Number 11, police body cam video and audio, was admitted into evidence. State's Exhibit Number 11 was not included in the reporter's record filed in this Court.

Texas Rule of Appellate Procedure 34.6(d) concerns supplementation of the reporter's record and provides that "[i]f anything relevant is omitted from the reporter's record," this Court "may by letter direct the official court reporter to prepare, certify, and file in the appellate court a supplemental reporter's record containing the omitted items." Tex.R.App.P. 34.6(d). Accordingly, the Court requests that the court reporter file the bodycam video that comprises State's Exhibit 11. The video must be filed in a supplemental reporter's record within seven days of the date of this order.

The Clerk of this Court is directed to cooperate with the court reporter, as appropriate, to provide for the safekeeping, transportation, and return of the original exhibit.

It is so ORDERED.
