United States District Court, S.D. New York
Jul 29, 2002
02 Civ. 5629 (LAK) (S.D.N.Y. Jul. 29, 2002)

Opinion

02 Civ. 5629 (LAK)

July 29, 2002

ORDER

Petitioner here seeks to confirm an arbitration award. The only alleged basis of subject matter jurisdiction is diversity or, more properly, alienage. The petition, however, does not sufficiently allege the citizenship of the petitioner. Sun Printing Publishing Ass'n v. Edwards, 194 U.S. 377 (1904). The action is dismissed for lack of subject matter jurisdiction.

SO ORDERED.
