In a complaint containing ninety causes of action, thirty-one of the causes of action are to recover damages under subdivision 3 of section 442-e Real Prop. of the Real Property Law. Defendants appeal from so much of an order as denies their motion to strike certain allegations from the thirty-one causes of action as sham and frivolous. Order, insofar as appealed from, affirmed, with $10 costs and disbursements. No opinion. Carswell, Acting P.J., Johnston, Adel, Sneed and MacCrate, JJ., concur.
