Order modified by striking out provision requiring plaintiff to stipulate not to bring another action against the defendant for the same cause, and as so modified affirmed, with ten dollars costs and disbursements to appellant on grounds stated in opinion in Kilmer v. Evening Herald Co. ( ante, p. 291). No opinion. All concurred.
