Pending before this court is plaintiff's Motion For Clarification wherein plaintiff seeks the status of this action brought under 42 U.S.C. § 1983; and the Report and Recommendation of the Magistrate Judge made pursuant to 28 U.S.C. § 636(b)(1)(B), and dated April 27, 2000, recommending that this action be transferred to the United States District Court for the Middle District of Alabama. Plaintiff's motion is GRANTED; this action is due to be transferred.

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and there having been no objections filed, the Report and Recommendation of the Magistrate Judge is hereby ADOPTED as the opinion of this court.

Accordingly, it is ORDERED that this action be and is hereby TRANSFERRED. to the United States District Court for the Middle District of Alabama.
