DECISION & ORDER ON MOTION

Appeal by Rajeev A. Khan from an order of the Supreme Court, Queens County, dated March 12, 2012. By decision and order on motion of this Court dated February 13, 2013, the appellant's appendix and brief were stricken and the appellant was directed to serve and file a replacement brief and a replacement appendix on or before March 15, 2013. The appellant has not complied with the decision and order on motion dated February 13, 2013

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, based on the appellant's failure to comply with the decision and order on motion of this Court dated February 13, 2013.
