ORDER


The motion of defendant Reda for summary judgment dismissing the complaint is granted for the reasons set forth in the report and recommendation of Magistrate Judge Gorenstein, dated September 6, 2002, to which no objections have been filed on behalf of plaintiff or defendant Reda. The objections of defendant Farrell are overruled without prejudice in view of the Attorney General's concession that the basis for the objections was not briefed before the Magistrate Judge. The action therefore remains pending as against defendant Farrell, whose time to answer or move with respect to the complaint is extended to and including October 15, 2002.

SO ORDERED.
