DECISION & ORDER ON MOTION

Motion by the defendants third-party plaintiffs-appellants-respondents, in effect, to enlarge the record on an appeal and cross appeal from an order of the Supreme Court, Nassau County, dated October 22, 2012, to include the record filed in connection with an appeal entitled New York Telephone Company v Supervisor of Town of North Hepstead, which was determined by opinion and order of this Court dated August 3, 2010, under Appellate Division Docket No. 2009-00264.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
