Burnett has again failed to establish a reasonable probability that the outcome of the trial would have been different absent counsel's alleged deficient performance. See Key v. State , 247 Ga. App. 796, 797 (2), 545 S.E.2d 363 (2001) (no prejudice from counsel's failure to elicit specific testimony from the defendant regarding the timing of a robbery where the jury had already heard evidence regarding the discrepancy in timing). (g) Burnett contends that counsel was ineffective for failing to request a jury instruction on sexual battery as a lesser included offense.
