Case No. 1D01-1726 (Fla. Dist. Ct. App. Feb. 8, 2002)

Opinion

Case No. 1D01-1726.

Opinion filed February 8, 2002.

An appeal from an order of the Circuit Court for Washington County. Russell A. Cole, Jr., Judge.

David P. Kever, pro se, appellant.

Robert A. Butterworth, Attorney General, and Sean F. Callaghan, Assistant Attorney General, Tallahassee, for appellee.

We elect to treat appellee's motion to dismiss as a confession of error that the trial court was without jurisdiction to issue the March 13, 2001, order. Accordingly, that order is quashed for lack of jurisdiction.

QUASHED.

ERVIN, BENTON and POLSTON, JJ., concur.

NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND DISPOSITION THEREOF IF FILED.
