We elect to treat appllee's motion to dismiss as a confession of error that the trial court was without jurisdiction issue the March 13, 2001, order. Accordingly, that order is quashed for lack of jurisdiction.

QUASHED.

ERVIN, BENTON and POLSTON, JJ., concur.
