ORDER DISMISSING LYNCH MANAGEMENT SERVICE, INC. WITHOUT PREJUDICE


The Court, having considered the stipulation and motion of the parties, and good cause appearing, hereby ORDERS, ADJUDGES AND DECREES:

1. That Lynch Management Service, Inc. be dismissed without prejudice;

2. That none of the remaining defendants may seek to apportion fault to Lynch Management Service, Inc. at trial by way of argument or on the jury verdict form;

3. That in the event that Lynch Management Service, Inc. is subsequently made a party to the litigation, the scheduling order will be amended and Lynch Management Service, Inc. will be allowed sufficient time to conduct discovery, including depositions of individuals who were deposed in the absence of Lynch Management Service, Inc.'s representation; and

4. That the caption of the pleading be conformed to remove reference to Lynch Management Service, Inc.
