Judgment and order reversed and new trial granted, with costs to abide the event, upon the ground that the rulings at folios 133 and 338 constituted error prejudicial to plaintiff's case, such as to require a new trial, as the case upon the merits was a close one. Jenks, P.J., Mills, Rich, Kelly and Jaycox, JJ., concur.
