HUSBAND AND WIFE, § 176separate maintenance, refusal of husband to take wife back as entitling latter to. Where parties separated by mutual consent and wife on several occasions following inception of litigation importuned husband for reconciliation and offered to live with him again if he would procure home for her and children, but husband refused, separate maintenance decree in favor of wife was proper since, as husband refused to take wife back, she was living separate and apart without fault on her part.

Appeal from the Circuit Court of Will county; the Hon. JAMES V. BARTLEY, Judge, presiding.

Decree affirmed. Heard in this court at the October term, 1946.
