Judgment affirmed, with costs.


This case was tried with the case of Winthrop v. The Manhattan Railway Company, decided herewith ( ante, p. 509), and presents precisely the same questions. For the reasons stated in the case of Winthrop v The Manhattan Railway Company the judgment appealed from in this case is affirmed, with costs. O'Brien, Rumsey, Williams and Parker, JJ., concurred.
