This matter having been appealed by plaintiff to the United States Court of Appeals for the Third Circuit; and said Court of Appeals having issued its judgment order in lieu of a formal mandate on May 26, 2006, which is to be treated in all respects as a mandate;

ORDERED that pursuant to the judgment order of the United States Court of Appeals for the Third Circuit, the order of the United States District Court, District of New Jersey, which affirmed the decision of the Commissioner of Social Security denying plaintiff disability benefits, is hereby affirmed.
