We REINSTATE this appeal.

On May 16, 2023, and June 1, 2023, this Court struck Volume 2 of the clerk's record because the record stated it was filed under seal, but there was no proper sealing order for the record. Since then, this Court has issued multiple orders to the trial court to determine whether the documents in volume 2 of the clerk's record should be subject to a sealing order and if so, to sign a sealing order and notify the district clerk. However, as of the date of this order, volume 2 of the clerk's record has not been refiled. In the meantime, the parties have filed their briefs, and the case is otherwise ready to be set for submission. Accordingly, the Court will treat the documents in volume 2 as not necessary for resolution of the appeal unless a party files a written objection within TEN DAYS of the date of this order. Otherwise, the case will be set for submission in due course.
