ORDER

The Court has considered Third Party Defendant's Motion to Dismiss and the responses. The Motion is hereby DENIED. Although the right to indemnification does not ripen until and unless the third-party plaintiff has been found to be liable, there is no prohibition against joining the third-party defendant as part of the underlying action.
