TREVIN KENNEDY & SHANNON KENNEDY, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Lewis R. Carluzzo, Chief Special Trial Judge

Giving due regard to the representations contained in respondent's status report, filed February 15, 2024, it is

ORDERED that this case is stricken for trial from the Peoria, Illinois, trial session scheduled to begin in that city on February 29, 2024, and continued with jurisdiction retained by the undersigned. It is further

ORDERED that respondent's motion for continuance, filed January 26, 2024, is moot. It is

ORDERED that unless a proposed stipulated decision is submitted sooner, not later than March 29, 2024, the parties in a joint written report, or separate written reports advise the Court as to the status of the case.

Because the Court normally conducts trial sessions in Peoria, Illinois, not more than once a year, if a proposed stipulated decision is not submitted when due, and respondent is not able to support a motion for entry of decision, the parties should expect that the case will be set for trial on a future date in Washington, D.C.
