ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


The Court has under consideration the Findings, Conclusions and Recommendation of the United States Magistrate Judge Paul D. Stickney on Defendants' Motion to Dismiss for Lack of Personal Jurisdiction, Insufficiency of Service of Process, and Failure to State a Claim Upon Which Relief Can Be Granted. No objections were filed. The District Court reviewed the proposed Findings, Conclusions and Recommendation for plain error. Finding none, the Court accepts the Findings, Conclusions and Recommendation of the United States Magistrate Judge.

Therefore, Defendants' Motion to Dismiss for Lack of Personal Jurisdiction, Insufficiency of Service of Process, and Failure to State a Claim Upon Which Relief Can Be Granted, filed March 6, 2002, is GRANTED.

The Court notes that on April 24, 2002, the Plaintiff filed a new Complaint, but did not cure the deficiencies which are the basis of the Findings, Conclusions and Recommendation of the Magistrate Judge herein accepted.
